8. WHATSAPP AND SMS COMMUNICATIONS

By providing your phone number and opting in through our website, demo request forms, or any other point of contact, you consent to receive communications from myEZcare LLC via WhatsApp and/or SMS. These may include demo confirmations, product updates, support messages, billing notifications, and promotional content.

 

WhatsApp is Not a HIPAA-Compliant Channel
myEZcare will never share Protected Health Information (PHI) or any patient-related data through WhatsApp or SMS. All clinical communications must occur exclusively through our secure HIPAA-compliant platform.

 

Data Shared with Meta (WhatsApp)
WhatsApp is operated by Meta Platforms, Inc. When you communicate with us via WhatsApp, your phone number, message metadata, and device information may be processed by Meta under their own Privacy Policy. We encourage you to review WhatsApp’s Privacy Policy at whatsapp.com/legal/privacy-policy before using this channel.

 

TCPA Compliance
In compliance with the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations, myEZcare LLC will only send WhatsApp or SMS messages to individuals who have provided explicit prior written consent. Message frequency may vary. Standard messaging rates from your mobile carrier may apply.

 

How to Opt Out
Reply STOP to any WhatsApp or SMS message, email [email protected] with subject “WhatsApp Opt-Out Request,” or call +1 (855) 888-9273. Opt-outs are processed within 10 business days. Transactional messages related to an active account are unaffected.

Data Retention for WhatsApp Communications
WhatsApp and SMS communication records are retained for up to 3 years from the date of last interaction.


9. INTERNATIONAL DATA TRANSFERS

myEZcare LLC is headquartered in the United States. If you access our services from outside the United States, your personal data will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

We implement appropriate safeguards for international transfers, including:

Communication records — 3 years
Billing and financial data — 7 years (tax and legal obligations)
Marketing consent records — Until consent is withdrawn, plus 1 year
Security and access logs — 180 days
WhatsApp and SMS records — 3 years
Analytics and cookie data — Up to 13 months

Upon expiry of the applicable retention period, personal data is securely deleted or anonymized in a manner that prevents re-identification.

myEZcare’s website and services are intended for business use by healthcare professionals and are not directed at individuals under the age of 18 (or the applicable age of majority in your jurisdiction).

We do not knowingly collect personal data from children. If you believe we have inadvertently collected data from a minor, please contact us immediately at [email protected] and we will promptly delete it.


14. HIPAA NOTICE

myEZcare LLC’s software platform is designed to be compliant with the Health Insurance Portability and Accountability Act (HIPAA). We execute Business Associate Agreements (BAAs) with all healthcare agency clients before any Protected Health Information (PHI) is accessed or processed through our platform.

 

Protected Health Information includes any individually identifiable health information — such as patient names, diagnoses, treatment records, and insurance details — transmitted or maintained by a covered entity or their business associate.

 

This public-facing Privacy Policy governs only website visitor data and business contact data. PHI is governed exclusively by the applicable BAA between myEZcare LLC and the covered healthcare entity.

myEZcare will never transmit PHI through non-HIPAA-compliant channels including WhatsApp, SMS, standard email, or social media.

15. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.

When we make material changes, we will:

– Send an email notification to users with active accounts
– Where required by law, obtain fresh consent before processing data under the new terms
